Terms of Use
Introduction
These Terms of Service govern your access to and use of Ohh (the Platform), operated by Eqo Media Limited (we, us, or our). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
Definitions
In these Terms: Platform means the Ohh website, apps, and related services. User means any individual or entity that accesses or uses the Platform. Content means any text, images, links, or other material submitted to or displayed on the Platform. Credits means a limited, non-cash, non-transferable or transferable (as described below) entitlement to access certain paid features within the Platform. Third-Party Services means services, websites, or platforms operated by third parties.
Eligibility and Use
You must be legally capable of entering into a binding agreement to use the Platform. You agree to use the Platform in compliance with all applicable laws and these Terms.
Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. You must provide accurate and up to date information. We may suspend or terminate accounts that provide false, misleading, or incomplete information.
Nature of the Platform
Ohh is a social and discovery platform similar in nature to mainstream social media services. We do not permit explicit or pornographic content. Content that is lifestyle-oriented, artistic, or suggestive may be permitted, provided it remains appropriate for a general social platform.
User Content and Licence
You retain ownership of your Content. By submitting Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, distribute, and promote that Content for the purpose of operating, improving, and marketing the Platform. This licence includes the right to make technical modifications required to store, display, and transmit Content.
Prohibited Content and Conduct
You must not upload, post, link to, or promote Content that is illegal, explicit, pornographic, deceptive, exploitative, or harmful. This includes, without limitation:
- Content involving minors or that sexualises or exploits minors
- Content that promotes sexual services, escorting, or illegal activities
- Non-consensual, coercive, or exploitative content
- Harassment, hate, threats, or intimidation
- Impersonation, fraud, or misleading representations
- Attempts to manipulate, scrape, reverse engineer, or disrupt the Platform or its systems
- Use of automated means (including bots) where prohibited or where it undermines Platform integrity
Credits, Paid Features, Transfers, and Visibility
The Platform may offer paid features, including Credits, boosts, subscriptions, or other enhancements. Credits are not money, have no cash value, and do not represent stored value or funds. Credits cannot be redeemed, withdrawn, exchanged for cash, or used outside the Platform.
Where enabled, Credits may be transferred between Users within the Platform. Such transfers are platform-only and non-cash. Transfers may be irreversible once completed. We may refuse, suspend, reverse, or limit transfers where reasonably necessary for compliance, security, fraud prevention, error correction, or enforcement of these Terms.
Visibility, reach, ranking, and results are not guaranteed and may vary based on multiple factors, including how the Platform operates, User settings, and enforcement actions.
Payments
Payments are processed by Third-Party Services such as Stripe or app store platforms. We do not store full payment card details. Any balances shown as Credits reflect platform-only entitlements and do not constitute money, stored value, or a financial account.
Refunds and Chargebacks
Digital services are generally non-refundable once delivered. Refunds may be issued at our discretion. If you believe a charge is incorrect, you agree to contact us first so we can attempt to resolve the matter.
Repeated or unjustified chargebacks, or chargebacks initiated without first contacting us, may be treated as a breach of these Terms and may result in suspension or termination of your account, loss of access to paid features, or revocation of Credits, to the extent permitted by law.
Moderation and Enforcement
We reserve the right, but do not assume the obligation, to monitor, remove, restrict, or disable access to any Content or account at our sole discretion, with or without notice. We may use automated systems and human review to enforce these Terms. We are not responsible for Content posted by Users, and we do not endorse User Content.
Third-Party Services and Links
The Platform may contain links to Third-Party Services. Third-Party Services are operated independently from the Platform. We do not control or endorse Third-Party Services and are not responsible for their content, policies, availability, or practices.
No Agency or Endorsement
Nothing in these Terms creates any partnership, agency, employment, or fiduciary relationship between you and us. You may not represent that you are acting on our behalf. We do not endorse Users, their Content, or Third-Party Services.
Indemnity
You agree to indemnify and hold harmless Eqo Media Limited from claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your Content, your use of the Platform, or your breach of these Terms.
Termination
You may stop using the Platform at any time. We may suspend or terminate access if you breach these Terms or if continued access poses a risk to the Platform, other Users, or third parties. Where reasonably possible, we may provide notice, but we are not required to do so.
Disclaimer
The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, specific outcomes, or error-free performance.
Limitation of Liability
To the maximum extent permitted by law, Eqo Media Limited will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or related to your use of the Platform.
Nothing in these Terms limits or excludes liability where it would be unlawful to do so, including for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
Changes to the Platform and These Terms
We may modify, suspend, or discontinue any part of the Platform at any time. We may also update these Terms from time to time. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
